Rules (conditions) for the purchase of goods in the online store "Laboratory of models"

1. GENERAL PROVISIONS.

The information posted on the website of the online store "Laboratory of Models" contains the terms of the product purchase offer and is a public offer in accordance with Article 437 of the Civil Code of the Russian Federation. The Buyer's acceptance is to place an order for the offered product.

In its activities, the online store is guided by the provisions of the Civil Code of the Russian Federation, the Law of the Russian Federation of 07.02.1992 N 2300-1 "On Consumer Rights Protection", the Rules for the sale of goods by remote means, approved by the Decree of the Government of the Russian Federation of 27.09.2007 N 612 and other current legislation of the Russian Federation.

These Terms and Conditions may be changed by the online store without any special notice, the new version of the Terms and Conditions comes into force after 5 (five) days from the date of its posting on the Site, unless otherwise provided by the new version of the Terms and Conditions, and does not apply to legal relations between the Buyer and by an online store that arose before the entry into force of the new version of the Rules (Conditions). 2. TERMS AND DEFINITIONS.

2.1. "Online store" is a part of a trading company /trading organization or a trading organization designed to provide the buyer via the Internet with the information necessary when making a purchase, including the assortment of goods, prices, seller, methods and conditions of payment and delivery, to receive messages from buyers via the Internet about the intention to purchase goods, as well as to ensure the possibility of delivery of goods by the seller or his contractor to the address specified by the buyer or to the pick-up point.

2.2 "Website of the online store" - a set of logically interconnected web pages belonging to the online store and administered by it, containing data on goods and conditions of their purchase, at the address https://lab-model.com .

2.3. "Product" is any real thing or electronic resource presented in the catalog of an online store on its website.

2.4. "Buyer" is a person who either purchases or orders goods, or intends to order or already uses goods for personal, family, household and other needs not related to the implementation of entrepreneurial activity.

2.5. "Personal data" – information provided by Federal Law No. 152-FZ of 27.07.2006 "On Personal Data" and Federal Law No. 149-FZ of 27.07.2006 "On Information, Information Technologies and Information Protection", voluntarily and consciously provided by the Buyer when placing an order in the online store and necessary for execution the online store of the Buyer's order. The online store, which processes personal data of Customers as necessary, has taken sufficient organizational and technical measures to protect personal data from unauthorized or accidental access to them or their destruction, modification, blocking, copying, distribution, as well as from other illegal actions.

2.6. "Personal Data protection" – measures taken by the online store to process the Buyer's personal data for the purpose of statistical processing, marketing research, improving the efficiency of each Customer's service, providing exclusive information about special offers, new products and other marketing materials.

2.7. "Order" is an electronic or oral request of the Buyer for the purchase of Goods from the catalog of the online store, agreed by the Parties, accepted and executed by the operator of the online store.

2.8. "Contract" is a purchase and sale agreement between the Buyer and the online store on the purchase by the Buyer of certain Goods at a certain price, with delivery within the agreed time limits on certain conditions of delivery or receipt.

2.9. "Services" – a set of measures of the online store in relation to the Buyer, carried out for the purpose of fulfilling the terms of the Contract, including, but not exhaustive, services such as delivery of the Order to the Buyer, informing the Buyer about the process of execution of the Contract, etc. When selling technically complex goods, the online store must inform the Buyer about the need to use qualified specialists for connection, adjustment and commissioning of technically complex goods that, according to technical requirements, cannot be put into operation without the participation of relevant specialists.

3. TERMS OF PURCHASE OF GOODS

3.1. Intellectual property protection.

3.1.1. All text information and graphic images posted on the website are the property of the online store.

3.2. Electronic catalog. Description and price of the Product.

3.2.1. The availability of Goods presented in the catalog of the online store is determined by the individual status of the Goods displayed in the genre catalog, as well as on the Product card with a detailed description of its characteristics.

3.2.2. All information about the Product presented on the website is informational in nature, is not an advertisement and cannot fully convey all information about the properties and characteristics of the Product.

3.2.3. Photos, diagrams, drawings, video images of Product samples in the catalog are the property of the online store or its counterparties. Each sample image is accompanied by text information about the Product. The quality of the settings and the features of the Buyer's computer screen may distort the color scheme of the presented Product. The buyer has the right to contact the online store's support service for additional information about the Product that interests him. At the request of the Buyer, the manager of the online store is obliged to provide (by phone or by e-mail) other information necessary and sufficient, from the Buyer's point of view, for him to make a decision on the purchase of Goods.

3.2.4. The product may have minor differences from the image presented on the website in color, shape, size or other parameters. Any characteristics of the Goods may be changed by the manufacturer of the Goods without prior notice. The product, in cases provided for by the legislation of the Russian Federation, has all the necessary certificates and fully complies with the norms and requirements of the legislation of the Russian Federation.

3.2.5. If the Buyer has any questions regarding the properties and characteristics of the Goods, before creating an Order, the Buyer should seek advice from the online store.

3.3. Information of the online store about the Product.

3.3.1. The website provides information about the main consumer properties of the Goods, about the address (location) of the seller, about the place of manufacture of the goods, about the full brand name (name) of the seller (manufacturer), about the price and conditions of purchase of the goods, about its delivery, service life, expiration date and warranty period, about the order of payment for the goods, as well as the period during which the offer to conclude the Contract is valid.

3.4. At the time of delivery of the goods to the Buyer, the following information about the Goods is additionally provided to him in writing:

3.4.1. the name of the technical regulations or other designation established by the legislation of the Russian Federation on technical regulation and testifying to the mandatory confirmation of conformity of the goods;

3.4.2. the price in rubles and conditions for the purchase of goods (works, services), including when paying for goods (works, services) after a certain time after their transfer (performance, provision) to the Buyer, the full amount to be paid by the Buyer, and the repayment schedule of this amount;

3.4.3. the warranty period, if it is established;

3.4.4. rules and conditions for the effective and safe use of goods (works, services);

3.4.5. information on the energy efficiency of goods for which the requirement for the availability of such information is determined in accordance with the legislation on energy conservation and energy efficiency improvement;

3.4.6. the service life or shelf life of the goods (works) established in accordance with the Law of the Russian Federation of 07.02.1992 N 2300-1 "On Consumer Rights Protection", as well as information about the necessary actions of the Buyer after the expiration of the specified periods and possible consequences in case of failure to perform such actions if the goods (works) after the expiration of the specified periods pose a danger for the life, health and property of the Buyer or become unusable for their intended use;

3.4.7. address (location), brand name (name) of the manufacturer (contractor, seller), authorized organization or authorized individual entrepreneur, importer;

3.4.8. information on mandatory confirmation of conformity of goods (works, services) specified in clause 4 of Article 7 of the Law of the Russian Federation of 07.02.1992 N 2300-1 "On Consumer Rights Protection";

3.4.9. information about the rules for the sale of goods (performance of works, provision of services);

3.4.10. an indication of the specific person who will perform the work (provide the service), and information about him, if it matters, based on the nature of the work (service);

3.4.11. indication of the use of phonograms in the provision of entertainment services by performers of musical works.

3.5. If the goods purchased by the Buyer were in use or a defect (deficiencies) was eliminated in it, the Buyer should be provided with information about this.

3.6. The responsibility of the Parties for the accuracy of the information.

3.6.1. Each Party is responsible for the unreliability of the information provided by it.

3.6.2. The online Store is not responsible for the accuracy and correctness of the information provided by the Buyer when registering on the Website and when creating an Order.
